Expelled Tennessee Lawmaker Can Sue Officials for Benefits

Former Tennessee lawmaker Jeremy R. Durham can sue state officials to seek lifetime health insurance and pension benefits he was denied after his expulsion from the state legislature, the U.S. Court of Appeals for the Sixth Circuit held.

Durham was expelled from the Tennessee House of Representatives in September 2016 after the governor convened a special session.

Last year, he sued the state administrators that denied him retirement and health-care benefits, alleging his expulsion violated the federal constitution. A federal district judge tossed the lawsuit after concluding that Durham didn’t have standing to sue.
