South Dakota Supreme Court Voids Recreational Pot Initiative

South Dakota became the first state to invalidate a voter-approved initiative approving adult-use cannabis, with the state Supreme Court on Wednesday tossing the measure citing flaws in how it was written.

Justices ruled the initiative (Amendment A) was an invalid measure that included a licensing and regulation plan for a newly legal substance. The court adopted arguments that the initiative overreached by including cannabis and hemp in one measure. Hemp is a cannabis plant that contains 0.3% or less of THC, the component that gives users a high.
